The Oklahoma Supreme Court granted OU linebacker Owen Heinecke’s motion to dismiss the NCAA’s appeal in his case against the association due to a premature filing.
The NCAA will have 30 days to appeal, according to the order, which was signed by Justice Dustin Rowe, and filed to the Oklahoma State Courts Network Tuesday. Seven other justices concurred with Rowe. Justice M. John Kane is listed as not participating in the decision.
Mike Houck, an associate athletics director, told OU Daily on Tuesday night the department would refrain from commenting on the case and advised the Daily to reach out to Heinecke’s legal counsel.
The Daily reached out to Mary Quinn Cooper, Heinecke's lawyer, but has not yet heard back.
Heinecke, who started the final five games of last season and earned All-SEC Second Team AP honors, was granted another year of eligibility on April 16.

Rowe, as well as Cleveland County Judge Thad Balkman, who first heard the case, are OU Law graduates.
Heinecke was among a small number of OU football players in attendance Monday night in Omaha, Nebraska, as the OU baseball team won the national championship.
After the game, OU baseball coach Skip Johnson greeted the players and quipped, “Y’all’s turn,” per a post on X by Josh Callaway of Sooners Illustrated.
