NORMAN — A Cleveland County judge has overruled a motion to dismiss a lawsuit against University of Oklahoma Regent A. Max Weitzenhoffer Jr. that accuses him of gender bias and using his influence to interfere with an assistant band director’s employment, according to a report from NewsOK.
District Judge Lori Walkley ruled in favor of Debra Traficante who is suing Weitzenhoffer, claiming he did not want a female marching band director and used his influence to keep her from being promoted to that position.
Attorneys for Weitzenhoffer filed a motion to dismiss the lawsuit, contending in a brief that Weitzenhoffer acted within his power as a regent and that regents have immunity against this type of lawsuit.
