Robbery case suspects' sentencing delayed

Two men accused of robbing an OU student at gunpoint in February will enter pleas upon completion of different rehabilitation programs, an assistant Cleveland County District Attorney said.

Victoria Gillespie said she recommended the two men for programs because of the suspects' ages.

At 3 a.m. Feb. 20, University College freshman Joshua Teer was sitting in his vehicle outside a residence hall parking lot on Jenkins Avenue and Lindsey Street when he was approached by a man getting out of a 2001 Chevy Impala, according to a court affidavit.

The man, who was wearing a mask with a white cloth over his head and face, held a 12-gauge pump action shotgun to Teer and demanded his wallet, according to police reports.

After Teer handed over his wallet, the masked man got in the passenger seat of the vehicle, according to a court affidavit.

While the OU Department of Public Safety recorded Teer's statement, the two suspects-the robber and the driver of the getaway car-were already using Teer's debit card, according to a court affidavit.

Five minutes after the robbery, the suspects attempted to withdraw money from an ATM.

After the ATM initially denied their transaction, the suspects tried to use Teer's debit card four more times throughout the morning, according to a court affidavit.

Two of the attempts were successful, totaling $1,122.45 in purchases at Wal-Marts in Norman and Moore.

During the investigation, police detectives from Moore obtained surveillance tapes from both stores and identified one of the suspects, according to an affidavit.

OUDPS arrested Michael Vincent Rustad, 19, after being positively identified by Moore police.

Rustad is charged with one felony count of robbery with a firearm.

Gillespie said Rustad entered a drug treatment program March 3 and was expected to stay at least 30 days, but is currently still receiving treatment.

Oklahoma City police arrested the other suspect, David Paul Wines, 21, three days after the robbery.

Gillespie said Wines is charged with robbery with a dangerous weapon and unauthorized use of a credit card.

Wines is currently in a delayed sentencing program.

"The delayed sentencing program is sort of like boot camp," Gillespie said. "We conduct a variety of pre-sentencing investigations which includes school and family history. We try to have them rehabilitate for six months."

After the program is completed, the district attorney's office will recommend an appropriate punishment, Gillespie said.

Rustad is scheduled to appear for sentencing Aug. 11 and Wines' next court date is Oct. 13, according to court documents.

Both men could face five years to life if convicted on all charges, Gillespie said.

"In this case, it doesn't matter which one of the individuals was holding the shotgun or who was driving," she said. "Both men are being charged with the same offense because of the violence of the crime."
