An OU business sophomore is under investigation for the sexual
assault of a fellow OU student, according to Norman police. As a
result of the investigation, drug trafficking charges have also
been filed against another OU sophomore.
The alleged victim, an 18-year-old woman, reported the rape on
Oct. 15, said Detective Chris Amason of the Norman Police
Department.
She told police that on the night of Oct. 14, she attended a
party at the Pi Kappa Phi fraternity house with friends from her
dorm, according to a Cleveland County court affidavit. She said she
drank two shots of tequila and added that she is not a heavy
drinker. At the party, she met a white male named Spencer, who
brought her along to his friend Elliot’s duplex at 2920
Oaktree Ave.
At the duplex of Elliot Edwin Poston, a 21 year-old OU
sophomore, the alleged victim met him and two other men, according
to the affidavit. In the kitchen, Spencer gave her three shots of
Captain Morgan’s brand rum. She gave Spencer a kiss on the
cheek. Her next memory is of waking up on an upstairs futon hours
later, completely naked except for her socks.
After gathering her clothing, which was scattered about
Poston’s home, she found Poston sitting on the steps of the
stairway and asked him for a ride, according to the affidavit. He
drove her to her dorm, where she confided in Hannah Kohler,
University College freshman.
“She came home Friday morning and told me what she thought
had happened,” Kohler said. The alleged victim said she
thought she had been raped the night before, Kohler said. Within
half an hour, Kohler took her to Goddard Health Center, where was
seen by a physician and a counselor.
The physician found two lacerations, one on her right breast and
another on the exterior of her vagina, and a bruise on her left
breast, according to the affidavit. She also felt pain on the
inside of her vagina.
The Goddard counselor accompanied her to the Women’s
Resource Center of Norman, where she was interviewed by Norman
police, Kohler said.
She identified Spencer Bradley Booth, business sophomore, as the
suspect in the assault, Amason said.
Amason served a search warrant at the duplex on Oct. 19, in an
attempt to obtain evidence of the rape, Amason said. He ended up
finding much more.
“Upon entry, I saw in the kitchen several baggies
containing white, powdery substance, approximately 6,” Amason
said. “There was a large amount of cash along with digital
scales to weigh out the drugs.”
Amason then contacted the Special Operations division of Norman
PD, who obtained a second search warrant to search for drugs.
Almost a quarter pound of cocaine and 46 ecstacy pills were found
at the duplex.
The sexual assault investigation spawned a drug trafficking
operation with an OU connection.
Poston and Cole Roberson Case, 37, of Wichita Falls, Texas, were
found in close proximity to the drugs, according to an affidavit
from the Cleveland County district attorney’s office. Poston
and Case have been charged with trafficking cocaine. They are not
being investigated for rape.
In regards to the sexual assault investigation, police recovered
bedding where the rape allegedly occurred and a bottle of alcohol
consistent with the victim’s description, Amason said. No
“date-rape” drugs were found at the residence.
While the alleged victim has no recollection of the incident,
Booth told police that he had consensual sexual intercourse with
her on the night the alleged assault took place, Amason said.
Amason stressed that Booth has been cooperative in the
investigation. He has not been charged with sexual assault.
“He’s assisting in my investigation and hasn’t
given me any problems or anything,” Amason said.
Booth declined to comment.
The alleged victim, who appears nameless due to The
Daily’s policy of not identifying sexual assault victims,
said she officially withdrew from classes on Monday and moved back
to her hometown to be with her family and attend counseling.
“It’s rough, and you need a lot of people around you
that are going to support you,” she said. “I
hadn’t been at school very long and wanted to go home.
Everything was fine; I loved OU until that night. A lot of
different things snowballed after that happened. I just needed to
go home for a while to heal and to figure things out.”
She said she does not feel completely safe at OU, but counseling
and having time to reflect will help return some normalcy to her
life by spring, when she plans on taking classes again.
“I think it will be better when I come back,” she
said.
She said the incident made her more critical of going out and
drinking. She said she doesn’t intend on drinking in the
future and will change her partying habits.
“I’m going to try and focus on school, getting
through and getting my degree,” she said.
She wants other girls to be careful if they ever find themselves
in a situation like she did that night, surrounded by strangers and
alcohol in a foreign setting.
“Make sure you’re with people you trust and that you
know,” she said. “You never really know what could
happen. Just make sure you’re always in control of yourself
and your situation.”
Poston and Case face felony drug trafficking charges and each
paid $10,000 bond on Oct. 18, assistant district attorney Michael
Tupper said.
